Senior Wins Bed Bug Suit In New Jersey
Despite the fact that the current version of the new bed bug law is still pending ratification in the New Jersey legislation, a Jersey City senior claims victory in court. The legal decision apparently shocked not only the defendant, but the plaintiff too!
The 68 year old senior wanted reimbursement for the costs that he incurred ridding his apartment of bed bugs. The clause that is so prevalent in many leases stating that tenants must pay for the cost of exterminating bed bugs, did not hinder the judge’s decision in the slightest.
The claim he was asking for was only for $299. The defendant surely paid more for his lawyer to represent him in court than the original claim against him. So I guess this means that all landlords in New Jersey should be put on notice from here on out. Landlords will likely continue to pay even retroactive bed bug claims! I sure hope that the landlord took care of the entire 200 apartment facility. If not, they are likely to see another 199 cases filed against them very soon.
